Top commercial real estate deals 2009 through the first quarter of 2010

The financial crisis of 2008 created a very slow commercial real estate market in 2009. However, activity started to pick up at the end of 2009 and into the first quarter. This collection of top deals and deal-makers from that period illustrates that nimble negotiators can close deals in a market where there are many worried tenants and financiers.

A number of the deal-makers were affiliated with other brokerages when the transactions closed. Their former affiliations are noted in parenthesis.

The “Top Deals and the People who Made them Happen” are listed by leases and sales for each county. They are based on submissions from the top 10 largest brokerages. Where applicable, the top five deals are highlighted.

Two years after defunct Levitz Furniture vacated its Rohnert Park store, brothers Anthony and Jonathan Bergland entered a three-year "creative leasing" deal to remake the store as a paintball-themed entertainment center, according to Mr. Laugero.

"It gives them a shot to make the business work and gives the owner mortgage relief," he said.

This sale and that of 151 Sotoyome St., mentioned below, were part of a winding down of a three-decade property investment partnership led by retired psychiatrist Daniel Marrin and former dentist Jim Berger, according to Mr. Smith.

Marketing of the Fulton property was undertaken amid a bid in previous years by Southwest Community Health Center, now called Santa Rosa Community Health Centers, to purchase the vacant land and build a clinic. The group eventually purchased an existing building, described below.

Westlake Village-based Fulton Santa Rosa, an investor in Signature Healthcare Services, operates six psychiatric hospitals and plans to open an acute psychiatric care hospital in 2011. Sonoma County had been without such a facility since early 2008.

For two years Santa Rosa Community Health Centers had been looking for a 40,000- to 60,000-square-foot office building to house a new clinic, according to Mr. Peterson. At the same time, the office real estate market softened, leaving much of the building vacant, and national debate over health care increased local planning for medical services.

After a nine-month escrow, which included a vigorous fundraising campaign, work on the clinic started, and it is expected to serve an additional 9,500 people.

Cisco Systems campus in Redwood Business Park, Petaluma

At the zenith of Telecom Valley, Cisco claimed it would have 2,000 employees in Petaluma and eventually purchased five research-and-development buildings for about $30 million. The downturn in telecom led to gradual reductions in the Petaluma team to the point that it was closed in mid-2009.

Much of the space was known to become available eventually as Cisco cut back, so it was a good thing that San Mateo-based turnaround specialist Cornerstone Properties came along to buy the campus, according to Mr. Heaton.

This was another part of the Brookwood LLC divestitures, which included the Fulton psychiatric hospital mentioned above. Santa Rosa Memorial had used the former convalescent care facility for palliative care on a leased basis for 10 years until March 2009. St. Joseph Health said it let the lease for this facility and that of the Fulton hospital lapse to cut costs. After 10 months of negotiations, the health care provider carved enough out of its budget to purchase the Sotoyome facility.

NSA Investments, led by Asil Gokcebay, founder of electronic keypad maker DigiLock, purchased the former AFC and Cisco buildings to accommodate future plans to expand DigiLock locally. The company is moving manufacturing from Santa Clara to Petaluma.

MKD had been asking $140 a square foot for the buildings in the fall of 2009. The right timing and the sophistication of both parties made the deal happen, according to Mr. Stevenson.

The property had been on the market for an extended period of time at $5.4 million to $5.7 million before an early 2009 price reduction, according to Mr. Peterson. The price was reduced further based on an appraisal later in the year that reflected the very slow leasing and sales markets.

The county plans to relocate and expand services to the building, which is located next to the County Administration Center, and reducing the county operations' carbon footprint was a factor, he said.

The lower rental rates of a sublease and the insurer's offer to include tenant improvements sweetened the deal. Travelsmith is relocating soon.

The Marin IPA deal was the first medical office in the property. Medical tenant improvements such as an elevator extended the closing of the lease until contingencies were fulfilled.

Teeper is the umbrella company for Cary Littell Jr.’s motorcycle dealerships, now called MotoMarin with added brands Aprilia, Guzzi and Vectrix electric scooters as well as the BMW cycles with which he started.

Mr. Littell wanted to relocate Marin BMW from 30 Castro Ave. in San Rafael almost a mile north to a “dream” location with Highway 101 frontage in the former Evolution Furniture store at 511 E. Francisco, according to Mr. Golden. After a year of negotiating, Mr. Littell and the ownership agreed on the rental rate.

Central Payment expanded from 5,400 square feet in The Brick Kiln. The company was looking for a location near the Richmond-San Rafael Bridge for East Bay employees and more parking than is average for office space for the call center, according to Mr. Buck.

The marketing team convinced San Rafael Land to woo Central Payment to the recently built property by passing on most of the savings of outfitting an entire wing, rather than having to demise the space, according to Mr. Eisberg. That lower rent cost plus improvements of around $100 a square foot convinced the company to sign a longer than average lease.

Kimco had a 10 percent stake in Novato Fair through a joint venture with Prudential established in 2006, just after Kimco completed a $4.1 billion merger with Pan Pacific Retail Properties, according to Kimco’s March 2 regulatory filing. The buyout included assumption of a $13.5 million nonrecourse mortgage and a gain of $3.4 million for the venture.

That assumable loan was a marketing feature when the Terranomics team took the property to the market, garnering a “substantial” number of offers, according to Mr. Wald.

The shopping center has had some changes in anchor tenants in the past year, with Safeway relocating to the new Hamilton Gateway center in the city and Dollar Tree set to take over junior anchor Big Lots space with the lease expiration this year.

Rowland Plaza, 75 and 88 Rowland Way, Novato

Price: $19,664,424 (sale price was about $117 a square foot per market sources)

Barker Pacific, which has redeveloped former aircraft hangars in Novato into a class A office development called Hamilton Landing, recognized a "great buy," according to Mr. Eisberg. The owner chose to liquidate the asset for cash.

Pre-arranged financing through Wells Fargo Bank and backing from Rockwood Capital helped seal the deal, Mr. Eisberg said. The buyers discounted the purchase price by the 25 percent vacancy rate in the property. Subsequent renewals with expansions, leases and offers are increasing the occupancy rate.

The Gary Place properties, which housed automotive repair and supply businesses, had been in and out of escrow for a few years. The deal with Sutter Health took a year and a half to get into escrow and another year to close because of the need to find properties for Mr. Fenton to acquire in an exchange.

A rapid reduction in large-scale warehouse space in the Fairfield area with the expansion of Jelly Belly and arrival of FedEx and Crystal Geyser made Meyer look to southern Napa County for temporary space, he said.

Mary Ryan McLaughlin and Andy, Ryan and Brian McGee, owners of Ryan McGee Bottling, looked around for a while to find a space with 14-foot-high roll-up doors to accommodate their mobile bottling trucks as well as floor drains for possible wine in washdown water, according to Ms. Holmes.

The project was half-committed when construction began last year, and with early leases to cork distributor Ramondin USA and wine fulfillment house DDC Shipping, the property reached 85 percent commitment as construction was just starting.

The custom wooden box maker, largely for high-end wines, moved to 10,000 square feet in St. Helena in 1996.

This 21-year-old shopping center, anchored by a Raley’s grocery store, was listed for sale at $23 million. It was one of 11 properties nationwide Kimco purchased last year from a previously mentioned 2006 joint venture with Prudential, according to a regulatory filing. Novato Fair Shopping Center was held differently in the venture.

Kimco had a 15 percent stake in these properties, the purchase of which throughout last year totaled $106.9 million, according to the documents. The total gain for the venture was $900,000, with about $100,000 going to Kimco, and the gain was used to pay down a credit facility that was part of the venture.
